The Roaring Texas Spanish Land Grant Giants Million+ Petition Project

We hereby decree:

We are Roaring Texas Spanish Land Grant Giants who will not be silenced until justice is served!

That our rights as legal descendants and Texas land grant heirs of oil and mineral rights our rightfully ours.

When the course of a human event like our happens, it becomes necessary for people to dissolve political bands which have connected them with another and to fight with human powers on the earth, a decent respect and justice that requires such a declaration of justice!

We hold with the Constitution of the United States of America, that all men are created equal, and that to secure certain rights, the instituted governments among men, must declare justice on our behalf!  For years the Texas Spanish Land Grant heirs have suffered injustice.   Whenever any form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it and to institute a new Government, laying its foundations on such principles and organizing its powers in such form, for justice.  While these evils are sufferable, it is much better to abolish these injustices.

We the Texas Spanish Land Grant Heirs are seeking justice as a result of the Oppressions suffered.  We have petitioned in most humble terms, without repeated injury.  We, therefore solemnly publish and declare:

The Texas constitutional provision has retrospective effect; the landowner was given complete ownership of the minerals in all lands that passed from the sovereign before the effective date of the Constitution of 1876.

The Texas Supreme Court in 1928, in Greene v. Robinson. Rather than holding the Relinquishment Act unconstitutional, the Court “construed” the Act in a way that would pass constitutional muster. It held that the Act did not relinquish the oil and gas to the landowners; instead, it made the landowners the agent of the State for the leasing of oil and gas rights, and granted to the landowner the right to one-half of all bonuses, royalties and other benefits accruing from those leases.

The 1876 state constitution was an amendment on the first passed in 1866. The legislature was getting ready to give the minerals to the state when someone slipped an amendment that gave the rights to landowners at that time. Those were the children and grandchildren of our land grantee and so we as legal heirs have the right to production from unclaimed Oil and gas wells in our ancestral lands. In 1866 there was no oil and gas discovered so the issue was not that important.

The money from our unclaimed wells has been spent by the state for 33 years instead of putting it in a trust fund.  We have not been paid yet, and our names are accounted for in the Texas Comptrollers record keeping.

We now declare this must be made right, all of the monies must be accounted for, for every mineral and oil drilling and site, the monies that are accounted for must be paid out to its rightful owners and decedents (the Texas Spanish land grant heirs).  To mandate that State of Texas to release the type 2 mineral billions of dollars in royalties, bonuses, etc. to their rightful Spanish land grant heirs and stop spending our money

We are ready for a legal war, we are ready to re-elect new officials in government that support our rights.  Our country has not seen a fight of civil liberties and justice in its history. Soon America will know who we are.  We are a revolution, we are a people, united in in one voice.  It is time for change, and for justice.
